Domain name registration agreement

Version 1.0. Last updated 27 October 2026.

Who this agreement is with

This agreement is between you, the person or business registering a domain name through our domains page (the registrant), and 2036studios (we, us). It applies to every domain name you register or renew through us, alongside our terms of service and privacy policy. If this agreement and the terms of service differ on a domain name matter, this agreement applies.

Our role and the registrar

2036studios is a reseller. Domain names are registered through Synergy Wholesale Pty Ltd, an accredited registrar for .au domain names and an ICANN accredited registrar, which registers each name with the relevant registry. We are not the registrar or the registry. We handle your order, payment, renewals and support, and act on your behalf with the registrar.

The domain is yours

The domain name is registered in your name, with you as the registrant. We never register it in our own name. A domain name is a licence to use the name for the registration period, granted by the registry under its rules; it is not property that anyone owns outright.

Registry rules you agree to

Every registration is subject to the rules of the registry for its extension, as they change from time to time. For .au names (such as .com.au, .net.au and .au) that means the .au Domain Administration (auDA) rules and policies, including the .au Domain Administration Rules: Licensing, published at auda.org.au. For generic names (such as .com and .net) it means the policies of the Internet Corporation for Assigned Names and Numbers (ICANN) and the registry, including the Registrant Benefits and Responsibilities and ICANN's registrant educational information. You agree to be bound by those rules, and to the registrar passing your details to the registry as they require.

Eligibility for .au names

A .au name needs an Australian presence and, for .com.au and .net.au, a close and substantial connection between the name and your business. You confirm that the Australian Business Number (ABN) or Australian Company Number (ACN) you give is yours, is active, and meets the eligibility and allocation rules for the name you register. auDA or the registrar may audit eligibility at any time, and a name that does not meet the rules can be cancelled by the registry without a refund.

Your details must be true

You must give true, accurate and complete registrant and contact details, keep them up to date, and tell us within 14 days of any change by emailing hello@2036studios.com.au. Giving false details, or not answering a registry or registrar request to confirm them, can lead to the name being suspended or cancelled under the registry rules.

Designated agent

You appoint 2036studios as your designated agent for each domain name you register through us. That lets us, on your instructions, approve and submit changes to the registrant and contact details, renewals, name server and DNS changes, and transfer requests with the registrar, and accept the registrar's and registry's terms on your behalf when a change requires it. We act only on your instructions or as this agreement says (for example, renewing a name you have not asked us to stop). You can end the appointment at any time by moving the name to another provider.

Price, term and payment

The price shown on our domains page is for one year of registration, in Australian dollars, and is the total you pay. You pay the first year by card when you order. The registration term starts when the registry accepts the registration. If a name you paid for cannot be registered (for example, someone else registered it first), we refund the payment in full.

Automatic renewal

Each name renews automatically every year, and the yearly price is charged to the card you used, about the date the name is due to expire, until you ask us to stop. We email you a renewal notice at least 30 days before the expiry date and a reminder 7 days before, to the email address on the order. Stripe emails you a receipt for each charge. If a charge fails, we tell you, and the name is not renewed until it is paid.

Stopping renewal and cancelling

You can stop the yearly renewal at any time by emailing hello@2036studios.com.au from the address on the order or by replying to any domain email from us. The name stays registered to you until the end of the year already paid, then expires. Registration fees cover a registration made with the registry, so a year that has started is not refunded, except where the Australian Consumer Law requires it. Nothing in this agreement limits a guarantee or remedy you have under the Australian Consumer Law.

Expiry and restoring a name

When a name is not renewed by its expiry date, it stops working for websites and email. A .au name can usually still be renewed for a short time after it expires, at the normal yearly price; after that the registry deletes it and anyone may register it. Generic names such as .com may go into a redemption period after expiry, during which the registry charges a restoration fee; if we sell generic names, the restoration fee is shown on our domains page before any such name is sold, and we always tell you the cost in writing before restoring a name. We do not keep or resell names that expire.

Transfers

You can move a name to another provider at any time. On request we give you the domain password (authorisation code) at no charge, usually within one business day, after confirming the request comes from the registrant. Registry rules may block a transfer in some cases, for example within a set period after registration, after a change of registrant, or while a dispute is open.

Changing the registrant

A change of registrant (for example, when you sell your business) is a transfer of the licence to a new registrant under the registry rules. The new registrant must be eligible and accept the registry rules. Ask us and we will arrange it with the registrar; the registry may charge a fee, which we tell you before going ahead.

Disputes over a name

A complaint that a name infringes someone else's rights is handled under the registry's dispute policy: the .au Dispute Resolution Policy (auDRP) for .au names, and ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP) for generic names. You agree to take part in any such proceeding, and that the registrar and we will carry out any decision. You are responsible for making sure your name does not infringe anyone else's rights.

Suspension and cancellation

The registry, the registrar or we may suspend, lock, transfer or cancel a name where the registry rules require it, where a court, tribunal, dispute decision or law enforcement agency requires it, where the name is used for unlawful or abusive purposes (see our acceptable use policy), or to correct a mistake in registration. We tell you before acting where we lawfully can.

Your information

Your registrant and contact details go to the registrar and the registry so the name can be registered and kept registered, as the registry rules require. Some details, such as the registrant name and, for .au names, the eligibility details, may appear in public domain lookup (WHOIS) records. Personal contact details are withheld from public records where the registry rules allow. Our privacy policy explains how we handle your information.

Websites and email on your name

Registration gives you the name, parked on the registrar's name servers. Pointing it at a website or email, and hosting either, are separate services we quote or provide under their own terms. We do not back up or keep copies of email or content held elsewhere.

Liability

Registrations depend on the registry and registrar, which we do not control. To the extent the law allows, we are not liable for a registry or registrar decision, outage or delay, for a name being registered by someone else before your order completes, or for loss caused by details you gave being wrong. Otherwise our liability for a domain name is limited to resupplying the registration or refunding what you paid for the current year.

Changes to this agreement

We may update this agreement, for example when registry rules change. Changes apply from your next renewal, and we email you about any change that affects you before it applies. If you do not agree, you can stop the renewal before it is charged.
